Учитывая то, что значительная часть наших сограждан постоянно рискует лишиться стабильных доходов, это оптимальная модель расчета за купленную квартиру.</p><p> </p><p dir="ltr">- А если пайщик окажется мошенником или переоценит свои финансовые возможности?</p><p> </p><p dir="ltr">- Финансовая безопасность кооператива обеспечивается тем, что на период расчета за средства, предоставленные кооперативом, квартира находится в собственности кооператива. Если член кооператива по различным причинам выходит из кооператива или исключается из него, паевой взнос полностью возвращается пайщику. Квартира либо передается другому пайщику, либо реализуется на открытом рынке.</p><p> </p><p dir="ltr">- При ипотечном варианте право собственности сразу оформляется за гражданина.</p><p> </p><p dir="ltr">- Да, но это собственность под обременением – под залогом! К тому же вы можете в любой момент эту так называемую собственность потерять вместе с вложенными деньгами. Или вследствие неплатежеспособности по инициативе банка. Или из-за того, что на объект недвижимости может быть обращено взыскание третьими лицами.</p><p> </p><p dir="ltr">Если пайщик кооператива систематически не исполняет свои обязательства перед кооперативом по внесению ежемесячных платежей, решением общего собрания пайщик исключается из числа членов кооператива, при этом внесенные им ранее паевые средства возвращаются ему в полном объеме.</p><p> </p><p dir="ltr">- Как работаете с квартирой?</p><p> </p><p dir="ltr">- Мы очень тщательно проверяем объекты жилой недвижимости, которые приобретаем в интересах пайщика, в том числе их ликвидность. Проводится юридическая экспертиза правоустанавливающих и технических документов, предоставленных продавцом объекта недвижимости. Проводится независимая оценка рыночной стоимости объекта недвижимости.</p><p> </p><p dir="ltr">Для ЖК важны гарантии, что объект недвижимости, в который вкладываются деньги, был ликвидный. Кооператив должен понимать: если пайщик окажется неплатежеспособным, сможет ли ЖК эту квартиру передать другому пайщику или продать на открытом рынке. Это для нас фактор безопасности: не потерять деньги пайщиков.</p><p> </p><p dir="ltr">- Каков правовой статус квартиры и пайщика, для которого она приобретается?</p><p> </p><p dir="ltr">- До момента полного погашения средств, предоставленных кооперативом, собственник квартиры -- кооператив. Кстати, в большинстве регионов он как некоммерческая организация освобожден от налога на имущество.</p><p> </p><p dir="ltr">Объект недвижимости приобретается целевым образом – для проживания конкретного пайщика и членов его семьи, потому не принимается кооперативом на учет в качестве основных средств. И в момент полного погашения долга за ту часть, которая внесена кооперативом, автоматически становится полноценным владельцем квартиры.</p><p> </p><p dir="ltr">Пока пайщик расплачивается за долю, внесенную кооперативом, он бесплатно получает квартиру во владение и пользование для себя и членов семьи, прописывается в квартире.</p><p> </p><p dir="ltr">- Развитие кооператива зависит от количества привлекаемых пайщиков?</p><p> </p><p dir="ltr">- Да, конечно. Но их ахиллесова пята - очередь. Первая квартира обычно покупается быстро, поскольку первую группу пайщиков сформировать не так сложно. Но потом их количество растёт медленно, а возвращаемые суммы недостаточны, чтобы покупать следующие квартиры.</p><p> </p><p dir="ltr">К примеру, один из московских ЖК, которому 13 лет, купил всего 104 квартиры. А наш кооператив - 100 квартир за первый год, в настоящее время более 500 объектов. Это объясняется нашей инновационной системой привлечения пайщиков, основанной на использовании механизмов сетевого маркетинга. Пайщики, для того, чтобы быстрее получить жильё, сами привлекают новых пайщиков, и при этом пайщики выступают в качестве консультантов.</p><p> </p><p dir="ltr">Чтобы быстрее получить квартиру, человек, вступивший в кооператив, заинтересован в привлечении людей. Это юридическое лицо, которое не преследует извлечение прибыли в качестве основной цели своей деятельности (пункт 1 статьи 123.1 ФЗ «О некоммерческих организациях»).</p><p> </p><p dir="ltr">Все пайщики вносят вступительный, членские и паевые взносы.</p><p> </p><p dir="ltr">Наш ЖК согласно Уставу вправе: во-первых, использовать денежные средства пайщиков на приобретение объектов недвижимости в их интересах.</p><p> </p><p dir="ltr">Во-вторых, покупать для пайщиков по их выбору объекты недвижимости на первичном и вторичном рынке недвижимости на территории Российской Федерации.</p><p> </p><p dir="ltr">В-третьих, ЖК предоставляет пайщикам объекты недвижимости в пользование на основании акта приема-передачи после приобретения ЖК прав собственности на данные объекты недвижимости. Ссылаясь на внутренние распоряжения, ПФР требует точный адрес объекта и конкретный срок приобретения жилья. Однако дело в том, что объект недвижимости пайщик выбирает после внесения им 35% от заявленной стоимости жилья и когда будут собраны средства для приобретения жилья пайщику, которые многие из них и хотят профинансировать за счет материнского капитала.</p><p> </p><p dir="ltr">В настоящее время ЖК «Бест Вей» участвует в разработке законопроекта о жилищной кооперации под эгидой фракции «Справедливая Россия».
